ANY INFORMATION ABOUT ENERGY SAVINGS, INCENTIVES, OR SYSTEM PERFORMANCE ON THE SERVICE IS FOR ILLUSTRATIVE PURPOSES ONLY AND DOES NOT CONSTITUTE A GUARANTEE OF ACTUAL RESULTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ION SOLAR, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

9. Changes to Terms

We may update these Terms at any time. The "Last Updated" date at the top of this page reflects the most recent revision. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. Material changes will be highlighted via a notice on the Service.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be replaced by a valid provision that most closely reflects the intent of the original.
